Charges against Joseph Cundiff, 29, of Hendersonville, were upgraded from aggravated assault to first-degree murder Tuesday morning, Feb.18 after his wife Ashlee Witham Cundiff died from a gunshot wound to the head.
Police were called to the couple’s Le Sabre Drive home in Hendersonville around 10 p.m. on Wednesday, Feb. 13 to discover Witham, 26 had been allegedly shot by her husband, who claimed the incident was accidental.
According to the arrest affidavit, Cundiff was intoxicated and cleaning his gun — “making it look pretty,” he told police — when it went off.
But police say Cundiff’s story just didn’t add up.
“When you get (to the house), you look at the evidence and what was told to us, things became inconsistent and sort of raised some red flags,” Det. Jim Vaughn with the Hendersonville Police Department said. “Our determination at this point, is that it’s going to be domestic violence related.”
