A Texas lawmaker, currently in his fifth marriage, has submitted a hand-written complaint against a Texas judge — the wrong judge as it turns out — over a recent ruling allowing two women to get married after 30 years. In an op-ed, in the Star-Telegram, Bud Kennedy explains that recently elected Texas House Rep. Tony Tinderholt’s complaint against District Judge David Wahlberg is not only misdirected, but may not have a legal foot to stand on. Tinderholt, 44, a former member of the U.S. Air Force and Army, wrote out a two-paragraph complaint to the State Commission on Judicial Conduct stating that Judge Wahlberg failed to give notice to the State Attorney General’s office when lifting a stay on the two women’s marriage…. “This judge deliberately violated statutory law, and this is unacceptable,” Tinderholt wrote.

It’s always found it amusing that some of those most opposed to and offended by the idea of marriage equality are Conservatives with somewhat less stellar matrimonial records of their own. Call me silly, but I’d think it would stand to reason that the person you’d want out front advocating against marriage equality would be someone with a rock-solid first (and only) marriage. If you’re going to stand for the “sanctity” of “traditional marriage,” why would you risk charges of hypocrisy by opposing same-sex marriage…when you’re on your 5th marriage?

And you think I make this stuff up….

Granted, I’m opening myself up to the “those who live in glasses houses….” argument, but then I’m not the one pulling a Tinderholt here, am I? My own matrimonial record is hardly pristine…but I’m not speaking out loudly against marriage equality.

As if Tinderholt’s argument wasn’t prima facie absurd enough given that he’s on his fifth marriage, his complaint was filed…wait for it…against the wrong judge. Not that it would have held up against either judge, of course, but it’s not too much to expect that if you’re going to accuse a judge of violating the law that you understand the law you believe was violated as well as who allegedly violated it..

According to attorney Brian T. Thompson who took part in the case involving the two women, Tinderholt’s complaint won’t hold up against either of the judges.

“It’s a shame that someone who’s taken on the responsibility of writing our laws has so much misunderstanding of the law,” Thompson said.

Indeed.

It’s also a shame that Tinderholt either A) is in no position to throw stones and advocate for the “sanctity” of “traditional marriage” when you’re on your fifth marriage and/or B) doesn’t recognize that Catholic Church frowns on divorce…particularly FOUR of them. Throw in filing a complaint against the wrong judge, and what you have is a full-fledged exercise in self-parody.

So explain to me again how marriage equality is a threat to the sanctity of “traditional” marriage?
